We strive to have our general terms and conditions as clear and transparent as possible. No fine print or difficult descriptions, but a clear and understandable story for both our guests and ourselves. If, despite our efforts, something is not clear, please let us know. The general terms and conditions and accommodation agreements are listed on our website; www.casalavinya.com. We advise our guests to take note of this. The general terms and conditions and house rules are considered to be understood and accepted for each payment of the deposit or the full rent.
Terminology
Casa la Vinya: with apartments for rent located at Carrer Nansaire 45, 17220 Sant Feliu de Guixols, Baix Empordà, Girona, Spain
Guest: a person who has made a reservation and is staying at Casa la Vinya and is registered as such
Main guest: the person who made the reservation at Casa la Vinya. The lead guest must be over 18 years old and is responsible for his/her fellow guests
Manager: the person who, as owner of Casa la Vinya, or on behalf of the owner, manages the apartments
Third parties: any other legal entity that is not a guest, manager or owner
Reservation: a confirmation of the reservation request by Casa la Vinya
Cancellation: the revocation or cancellation of the final reservation within the applicable term or a no-show at the time of the reservation of an apartment in Casa la Vinya
1.1 The facilities of Casa la Vinya are described on the website www.casalavinya.com. This website has been compiled with care. There may be differences between the text and/or photos presented on the website and the current situation in Casa la Vinya at the time of a visit by guest(s). However, no rights can be derived from such differences.
1.2 The minimum stay in Casa la Vinya during the peak season is 7 nights. Outside this period a minimum stay of 3 nights applies.
1.3 Casa la Vinya has its own lockable entrance, guests have access to the grounds and apartments. Arrival and departure during rest periods is not preferred.
1.4 Rest times are from 11 pm – 7 am. During this period, guests are expected not to cause any noise nuisance, Casa la Vinya / the manager and family will also respect these times. Exceptions to this will be announced in good time.
1.5 For your own safety it is forbidden to smoke or use open fire in the apartments. The misuse of fire/extinguishing agents or disabling smoke detectors is not permitted.
1.6 Guests’ pets are not allowed in/at Casa la Vinya, unless otherwise agreed between the main guest and the manager.
1.7 The apartments are suitable for four people. A reservation is therefore for a maximum of four people, unless otherwise agreed upon when making the reservation. It is not allowed to bring unregistered guests into the accommodations and on the premises of Casa la Vinya. Any unregistered visitors can only access with our express permission.
1.8 The check-in time is between 4:00 PM and 7:00 PM. Check-out must be done between 9:00 AM and 10:00 AM.
The apartment must be left clean and tidy on the day of departure:
- Used towels are on the floor;
- Bedding have been collected;
- Waste from the entire apartment has been removed;
- Dishes have been done or have been washed in the dishwasher.
Deviating check-in and check-out times are only possible after prior consultation and approval of the manager. A surcharge (50% of the nightly price) may be charged for this.
1.9 Casa la Vinya is not suitable for people with walking difficulties, disabled people.
1.10 Guests can park their car in the closed parking lot in front of Casa la Vinya. Parking is at your own risk.
1.11 Guests must identify themselves on arrival with a valid identification. We also ask for your full address and contact details. We are obliged to provide this information to the government.
1.12 Guests must follow the instructions of the administrators.
1.13 The administrators can deny guests access to Casa la Vinya with immediate effect, in the event of violation of the general terms and conditions and/or accommodation agreements or in the event of inappropriate behavior, without refund of accommodation costs.
1.14 Guests of Casa la Vinya must adhere to the accommodation agreements, which can also be requested for inspection.
1.15 All persons who use the swimming pool do so at their own risk. The owners of Casa la Vinya are not responsible for any accidents or injuries. Toys such as rings, balls or inflatable objects are not allowed in the pool.
Swimming pool opening hours 9am – 8pm.
1.16 Where WiFi Internet access is provided, Guests agree to use such Internet access fairly and appropriately.
2.0 Rates
2.1 The stated rates include the consumption of water and electricity. The rates include applicable government taxes, bed linen, towels and final cleaning, excluding city tax.
On arrival we ask for a deposit of €200. This deposit will be returned to your account without damage 2 days after your departure if the apartments are used.
2.2 The rates are exclusive of costs of cancellation and/or travel insurance and/or other costs of optional reservations.
2.3. The rates mentioned are without obligation and their offer is subject to interim changes.
2.4 All entries on the website of Casa la Vinya www.casalavinya.com are provided in good faith and are always subject to interim adjustments. Casa la Vinya is not bound by obvious errors on its website.
3.0 Reservation and payment
3.1 Direct reservations are possible online at www.casalavinya.com. Reservations can also be made by phone, whatsapp or email. In addition, Casa la Vinya can be booked through commercial booking websites. For reservations through commercial booking websites, the booking conditions of these organizations apply.
3.2 A direct reservation is final after written confirmation of the reservation request by Casa la Vinya.
By using the information and services on www.casalavinya.com, you agree to our privacy policy and the terms and conditions that we have incorporated herein.
For direct reservations made more than 30 days before the check-in date, 25% of the total travel sum (excluding additional costs and taxes) must be paid within 5 days after reservation. The remaining 75% of the total travel sum (excluding additional costs and taxes) must be paid no later than 30 days before the check-in date. If the check-in date is within 30 days of the reservation date, the total travel sum (excluding additional costs and taxes) must be paid in full within 3 days in advance. After receipt of the (down) payment, the reservation is confirmed. If the (down) payment is not received on time, Casa la Vinya reserves the right to cancel the booking, without refund of already made (down) payments.
3.6 Payments can be made to bank account in the name of P.C.M. Metzemaekers ABN-AMRO NL87 ABNA 0492 4327 83 .
3.7 Payment of tourist tax and any additional costs must be paid at check-in in cash or by BIZUM/Tikkie.
4.0 Cancellation
4.1 For reservations via commercial booking websites, the cancellation conditions of these organizations apply. Casa la Vinya advises its guests to take out fully covering all-risk travel and cancellation insurance for booked stays.
4.2 (Deposit) payments on confirmed direct bookings are non-refundable.
4.3 In the event of a no-show, a cancellation after arrival, or an early departure during the stay, the confirmed total travel sum (excluding additional costs and taxes) will remain due and no refund will be made.
4.4 Cancellations can only be made by email via www.casalavinya.com, stating the reservation number.
4.5 Casa la Vinya can only cancel the reservation agreement in case of force majeure (see art. 7.1). In these cases Casa la Vinya will make the guest an alternative offer as soon as possible. If this is not possible or if the guest does not accept the alternative offered, the total paid travel sum will be refunded. The manager is not liable for any other damage as a result of a cancellation by Casa la Vinya.
5.0 Damage
5.1 The guest must behave properly and use the accommodation of Casa la Vinya in accordance with the instructions for use and accommodation agreements given.
5.2 The (main) guest is jointly and severally liable for any damage caused by him/her or fellow guests to the accommodation or the items present therein. The actual damage is at the discretion of the manager of Casa la Vinya.
5.3 A claim (damage, loss, missing and/or theft) must be reported immediately by the guest to the manager. Repair and or replacement costs must be immediately reimbursed by the guest to the manager.
5.4 Keys to the apartments must be returned upon check-out. In the event of loss or otherwise non-return of keys or other items on loan from Casa la Vinya, all resulting costs will be charged to the main guest. These charges must be paid before check-out.
6.0 Complaints
6.1 Although Casa la Vinya will do everything it can to prevent complaints, we would like to hear from our guests when something is not satisfactory or does not go well. We will try to resolve a complaint quickly and adequately within our capabilities.
7.0 Force majeure
7.1 In the event of extreme force majeure, both permanent and temporary, Casa la Vinya is entitled to dissolve or temporarily suspend the agreement in whole or in part, without the guest being entitled to fulfillment and/or compensation. Extreme force majeure includes, but is not limited to: danger of war, war, insurrection, molestation, strikes, boycotts, disruptions in the energy circuit, traffic or transport, government measures, scarcity of raw materials, natural disasters, pandemics (COVID-19 ) and furthermore all circumstances, extraordinary weather conditions, death of one of the owners or close relatives, etc. under which full or partial fulfillment of the agreement cannot reasonably and fairly be requested from Casa la Vinya. In these cases Casa la Vinya will make an alternative offer to the guest as soon as possible. If this is not possible, or if the guest does not accept the alternative offered, the total paid travel sum will be refunded. The manager is not liable for any other damage as a result of a cancellation by Casa la Vinya.
7.2 In the event of extreme force majeure beyond the reservation’s control, such as: pandemics (COVID-19), impossibility to travel due to extreme natural disasters such as earthquakes or tsunamis, during (terrorist) attacks, Casa la Vinya will provide an alternative as soon as possible. make an offer to the guest. If this is not possible, or if the guest does not accept the alternative offered, the total paid travel sum will be refunded. Casa la Vinya strongly advises its guests to take out cancellation insurance.
8.0 Liability
8.1 Casa la Vinya cannot be held liable for damage suffered by the guest or third parties during the stay in the accommodation. Casa la Vinya is not liable for malfunctions in and around the accommodation, such as failure of power and water supplies and technical installations, as well as construction and/or road works in the vicinity of the apartments that have not been announced or have been announced late.
8.2 Casa la Vinya can only be held liable for damage that is due to gross negligence or negligence of the manager.
8.3 Without prejudice to the provisions of 8.1 and 8.2, the liability of Casa la Vinya, if and insofar as Casa la Vinya is held legally liable for any reason with regard to the reservation agreement, is always limited to direct damage and any form of consequential damage is excluded. The liability of Casa la Vinya is also always limited to the maximum amount that the insurer of Casa la Vinya will pay out in the appropriate case.
8.4 Casa la Vinya accepts no liability for injury to persons and/or damage, loss or theft of property of the users.
9.0 Privacy
9.1 Casa la Vinya respects the privacy of its guests. The personal data provided or made known will be treated confidentially by the owner(s)/manager(s) and will not be made available to third parties, except on the basis of the registration obligation imposed by the government.
10 Final provision
10.1 Insofar as not provided otherwise in private international law rules, the present terms and conditions are exclusively governed by Spanish law. The general terms and conditions are available in Dutch, Spanish and English. In case of differences of interpretation due to translation, the Dutch version and explanation thereof shall prevail.
10.2 Any disputes arising from the reservation agreement or these terms and conditions will be settled in the first instance by the competent court in Spain, insofar as the rules of private international law do not provide otherwise.
10.3 None of the parties can transfer its rights and obligations to third parties, unless otherwise stated in these terms and conditions.
10.4 If and insofar as any provision in the reservation agreement and these terms and conditions should prove to be invalid, the other terms and conditions will remain in force and the invalid article will be deemed to have been converted in such a way that it is brought into line with the apparent intentions of the parties.
